USE OF OUR WEBSITE

By using this website and placing orders through it, you agree to:

  • Make legally valid inquiries or orders.
  • Not place any false or fraudulent orders. If an order of this type is reasonably suspected, we are authorized to cancel it and inform the relevant authorities.
  • Not purchase products from our online store for resale. We only sell to end customers, and violation of this condition is prohibited.
  • Provide us with your email address, postal address, and/or other contact information accurately. You also consent that we may use this information to contact you if necessary. If you do not provide all required information, we cannot process your order. By placing an order through this website, you declare that you are over 18 years old and legally capable of entering into a contract.

When the customer places an order, they are obliged to read and confirm that they have read these general terms and conditions of contract, as well as the additional links provided here. If, after reading these terms, the customer places an order, they are confirming their agreement with Optimal Optic.

AVAILABILITY OF SERVICE

The online store does not yet show the real stock of the product (for about 75% of the products we do have units available for immediate shipping). To confirm stock, the customer can contact us through the contact form. If the product is not available but the supplier has units, the approximate delivery time would be 5 to 10 additional days. If the supplier is manufacturing units, delivery could take 1 to 2 months. This will be communicated to the customer via email or phone.

HOW TO PLACE AN ORDER

To place an order, follow the online purchase procedure, first selecting the products of interest, filling in all mandatory information during the process, and confirming the purchase at the end.

Our product prices include VAT (unless there is a technical error that prevents this). The final price is the one displayed in the cart once the shipping address is entered, before payment is made.

Prices are valid except in case of error; we reserve the right to cancel the order in such cases, refunding the customer and notifying them.

Products are delivered with the original manufacturer’s cases and documents.

On our online store (https://optimaloptic.com), you can register to place orders, track them, and access the latest products offered by the brands for which we are official distributors. For any questions, use the order number provided at the time of purchase. The customer can download the purchase invoice from their account.

You will then receive an email confirming receipt of your order. We will also notify you by email when your order has been shipped.

TECHNICAL MEANS TO CORRECT ERRORS

If you detect an error when entering your personal data during registration as a user of this website, you can correct it in the "My Account" section.

In any case, you can correct errors related to personal data provided during the purchase process by contacting customer service via email at info@optimaloptic.com, and exercise the right of rectification provided in our privacy policy.

This website shows confirmation windows in various parts of the purchase process that prevent proceeding if the data has not been provided correctly. It also displays details of all items added to your cart so that, before payment, you can modify your order details. If you detect an error after completing payment, contact customer service immediately at the email address mentioned above to correct the error.

VALUE ADDED TAX AND INVOICING

In accordance with Article 68 of Law 37/1992 of 28 December, on Value Added Tax, the delivery of items will be considered located in the Spanish VAT territory if the delivery address is in Spain (except Canary Islands, Ceuta, and Melilla) and in European Union countries.

The applicable VAT rate will be the legally valid one at each moment. Orders delivered to the Canary Islands, Ceuta, Melilla, and countries outside the EU are exempt from VAT under Article 21 of Law 37/1992, without prejudice to applicable taxes and duties under the laws of these territories.

The customer can download invoices for purchases made by accessing their order history with their user credentials. However, the customer may request a copy of the invoice at any time.

SECURE SSL PAYMENT

We use secure payment with buyer verification by their financial institution to ensure that the buyer is the one actually using the payment method.

The customer has 15 calendar days from the moment they receive the order to make a return.

We only accept returns of products that have not been used, are intact (with all accessories, including the box), and can be resold.

WARRANTY POLICY

All our glasses have a three-year warranty for purchases from January 1, 2022. This warranty covers manufacturing defects, never damage from misuse or wear. To use the warranty, contact us via email or phone.

LIABILITY

Unless expressly stated otherwise in these Conditions, our liability regarding any product purchased on our website is strictly limited to the purchase price of the product.

INTELLECTUAL AND INDUSTRIAL PROPERTY

You acknowledge and consent that all copyright, trademarks, and other intellectual or industrial property rights on materials or content provided as part of the website belong to us or our licensors. You may use such material only in the manner expressly authorized. This does not prevent you from using the website as necessary to copy information about your order or contact details.

VIRUSES, PIRACY, AND OTHER CYBER ATTACKS

You must not misuse this website by intentionally introducing viruses, trojans, worms, logic bombs, or any other technologically harmful or damaging programs or material.

You must not attempt unauthorized access to this website, its server, or any server, computer, or database connected to the website.

You agree not to attack this website through a denial-of-service or distributed denial-of-service attack.

Violation of this clause may constitute legal infractions. We will report violations to authorities and cooperate to identify the attacker.

Additionally, in case of breach, you will immediately lose authorization to use the website.

We are not responsible for any damage or loss resulting from denial-of-service attacks, viruses, or other harmful programs or materials affecting your computer, equipment, data, or materials due to website use or content downloads.

NOTIFICATIONS

Notifications are considered received at the moment they are posted on our website, 24 hours after an email is sent, or three days after posting any letter.

FORCE MAJEURE

We are not liable for any failure or delay in fulfilling obligations caused by events of force majeure.

Force majeure includes any act, event, lack of exercise, omission, or accident beyond our reasonable control, including:

  • Strikes, lockouts, or other industrial actions.
  • Civil unrest, riots, invasion, terrorist threat or attack, war (declared or not), or preparations for war.
  • Fire, explosion, storm, flood, earthquake, collapse, epidemic, or other natural disasters.
  • Inability to use trains, ships, airplanes, motorized transport, public or private.
  • Inability to use public or private telecommunication systems.
  • Acts, decrees, legislation, regulations, or restrictions from any government or authority.

Obligations will be suspended while the force majeure event continues, and we will have an extension of time equal to the duration of the force majeure.

We will take all reasonable steps to end the force majeure event or find a solution to fulfill our obligations despite it.

WAIVER

Failure on our part to strictly enforce any obligation under a contract or these Conditions, or to exercise our rights or actions, does not constitute waiver or limit these rights or actions, nor exempt you from your obligations.

No waiver by us of any specific right or action constitutes a waiver of others. No waiver will be effective unless expressly stated and communicated through your provided contact information.

PARTIAL INVALIDITY

If any condition or contract provision is declared null by a competent authority, the remaining terms will remain in force.

OUR RIGHT TO MODIFY THESE TERMS

We reserve the right to modify these terms and conditions. Substantial changes will be communicated. Changes are not retroactive and will apply 10 days after publication unless exceptions apply. If you disagree with modifications, we recommend not using the website.

APPLICABLE LAW AND JURISDICTION

In case of disagreement in the commercial relationship, customers are encouraged to contact Customer Service to resolve disputes amicably (see Comments, Suggestions, Complaints and Claims section).

Any disputes related to the website or product purchases through the Online Store or physical stores will be governed by Spanish law, including:

  • Law 7/2017, incorporating Directive 2013/11/EU into Spanish law.
  • Law 3/2014, amending the revised text of the General Law for Consumer Protection and other complementary laws.
  • Regulation (EU) No. 524/2013 of the European Parliament and Council.
  • Royal Legislative Decree 1/2007, approving the revised text of the General Law for Consumer Protection.
  • Law 32/2003, General Telecommunications Law.
  • Law 34/2002, Information Society Services and E-Commerce.
  • Law 7/1998 on General Contracting Conditions.
  • Law 7/96, on Retail Trade Regulation.
  • Any applicable legal provisions.

In case of dispute not resolved extrajudicially, the competent courts will have jurisdiction. For consumers, it will be the court of their residence.

If the buyer resides outside Spain, both parties submit to the courts of the seller’s registered office in Alicante (Spain).

COMMENTS, SUGGESTIONS, COMPLAINTS, AND CLAIMS

Your comments and suggestions are welcome. Please send them, along with any queries, complaints, or claims via our contact form, phone, postal or email address indicated in Clause 2 of these General Terms.

Official complaint forms are available to consumers. They can be requested via our contact form.

Complaints to our customer service will be addressed as quickly as possible, and in any case within one month. They will be recorded with an identifier allowing you to track them. If you feel your rights have been violated, you can send complaints via email for extrajudicial resolution.
